US To Conduct 2nd Lottery Round For H-1B Applicants
The (USCIS) which means United States Citizenship and Immigration Services, has recently announced a new and second lottery round for random lottery selection for H-1B visas for the fiscal year (FY), which includes the year ended 30 September 2024.
The USCIS conducted an initial random selection of the lottery round in March for the fiscal year (FY) 2024 H-1B cap and for those who have correctly submitted the electronic registration, including the beneficiaries suitable for the advanced degree exemption.
To file H-1B cap-subject petitions, only those petitioners who have selected registrations for FY 2024 are eligible. The initial filing period for people with their determined registrations for Fiscal Year 2024 was started from 1 April 2023 to 30 June 2023.
USCIS said in a statement that we decided that we would require to select more registrations to reach the Fiscal Year 2024 numerical allocations. That’s why we will select more registrations soon from the previously submitted electronic registrations by using a random selection procedure.
We will announce the results once the second selection process is complete and notify all prospective petitioners with selected registrations. If your registration is selected, you can file an H-1B cap-subject petition for the beneficiary named in your registration.
Individuals chosen for registration will receive an update on their myUSCIS accounts, including a notice of their selection. This notice will inform them when and where they should file their application.
According to immigration experts mentioned in a report by TOI, a second round of lottery may be necessary due to the prevalence of fraudulent practices. It includes American sponsoring entities filing multiple H-1B cap registrations for the same prospective employee in collaboration to increase their chances of winning the lottery.
For fiscal year 2022, the US held multiple lotteries due to a low volume of visa applications from American sponsoring entities. The second lottery occurred in July 2021, followed by another in November 2021.
In the H-1B cap season for the fiscal year ending September 30, 2024, USCIS received 758,994 eligible registrations. Out of these, 110,791 registrations were selected by USCIS to meet the annual allotment of 85,000.
