An EAD or Employment Authorization Document (Form I-766/EAD) is a method for individuals to prove they can work in the US. It welcomes respite for immigrants caught between releases and long visa backlogs.

These benefits are given to certain nonimmigrants, along with their spouse and children, who are beneficiaries of approved employment-based immigrant visa petitions. They face compelling circumstances and are caught in the continuously expanding backlogs for immigrant visas.

This temporary solution aims to resolve challenging circumstances, such as situations that previously caused individuals on the way to becoming lawful permanent residents to stop working and depart from the United States suddenly.

Eligibility Requirements For An Initial EAD

You need to complete the following eligibility requirements to be eligible for an initial EAD.  

  • If you have an approved Form I-140, Immigrant Petition for Alien Workers, in the 1st, 2nd, or 3rd employment-based preference category, you are the primary beneficiary of its benefits.
  • You must come under a valid H-1B, O-1, H-1B, H-1B1, and L-1 nonimmigrant status or an authorized grace time when you file Form I-765, Application for Employment Authorization.
  • You must not have filed an adjustment of status application;
  • Suppose the applicant’s priority date does not match the Final Action Date in the U.S. Department of State’s Visa Bulletin when filing Form I-765. In that case, you are not eligible for an immigrant visa.
  • Both you and your dependents must provide biometrics as needed;
  • The applicant and his dependents have not been convicted of a felony or two or more misdemeanors.
  • USCIS can grant you employment authorization if you demonstrate compelling circumstances that justify it.

If you receive an EAD due to compelling circumstances and start working with it, you’ll be considered in an authorized stay period but won’t maintain your nonimmigrant status anymore. 

However, you won’t accumulate unlawful presence in the U.S. during the validity of the EAD or while your application is under review as long as it was filed on time and isn’t frivolous.
